There are two types of tenancies:
- Fixed Term: This is for a specific period of time. You should not
sign a fixed term agreement if you do not intend on staying there for the
full time as breaking this agreement can be costly. (Refer to Ending
a Tenancy)
- Periodic: This means that there is no time limit. Periodic tenancies
are rarely given for vacant units and are more common in boarding houses.
Before a tenant enters into a tenancy agreement, the landlord or the landlord's
agent must provide a list of all entry costs payable to begin the tenancy and
a copy of the proposed tenancy agreement. Before you sign the agreement, it
is important to read the tenancy agreement carefully. Ensure that all terms
of the agreement are put into writing. The landlord must give you a copy of
the tenancy agreement within 1 month after you have signed it.
The landlord cannot require a tenant to buy goods and services from the landlord
as a condition of entering the tenancy agreement. For example, additional terms
which are illegal to be added to a tenancy agreement includes asking the tenant
to have the carpet cleaned when they vacate and asking the tenant to replace
tap washers or stove elements.
The Residential Tenancy Authority (RTA) states that it is possible to enter
a tenancy agreement if you are under the age of 18. However, this will depend
on whether your
tenancy agreement
is considered a "necessity of life".
